Many Telecommunication leases fall under the scope of the Landlord and Tenant Act 1954 (“The ’54 Act) which regulates Business Tenancies. Whilst not all Telecoms leases are regulated by the ’54 Act, unless a lease is specifically excluded from the Act, it will be regulated by the Act. However, the Telecommunications Act 1984 (as amended by the Communications Act 2003), also known as the Telecoms Code, outlays certain statutory rights relating to the Operator.
